1. Scope and Provider

1.1 These General Terms and Conditions apply to all purchases made through our online shop and any contract formed between you (“the Customer”) and Borrisons Chocolatier (“we”, “us”, “our”). By placing an order, you confirm you have read, understood, and agree to be bound by these terms.

1.2 Purchases are only available to persons aged 18 years or older. If purchasing on behalf of a business, you confirm you have the authority to bind that business. A “consumer” means an individual buying products for personal, non‑commercial use.

1.3 The contract language is English. All communications and agreements will be in English.

2. Conclusion of Contract

2.1 The display of products on our website is not a legally binding offer, but an invitation to treat.

2.2 You place an order by adding items to your basket, checking details, and clicking “Place Order with Payment Obligation”. This constitutes your offer to buy.

2.3 After ordering, you will receive an automatic email confirming we have received your order. This is not an acceptance of your offer. A contract is only formed when we send you a confirmation email confirming dispatch, or when the goods are delivered.

2.4 Minimum order value: £15 for Local delivery orders only. This does not apply if you are purchasing gift vouchers only.

2.5 If we cannot supply an item (e.g. out of stock, pricing error, or delivery issue), we will notify you by email. If payment has been taken, we will issue a full refund without delay.

3. Gift Vouchers and Greeting Messages

3.1 Gift vouchers are sent by email and are valid for 3 years from the date of issue. They can only be used once; any remaining balance is non‑refundable and cannot be carried forward.

3.2 We accept no responsibility if you provide an incorrect recipient address. If notified before the voucher is redeemed, we can cancel and re‑issue a new code.

3.3 You may add a greeting message to your order. Content must be legal, respectful, and not offensive, defamatory, or infringing third‑party rights. We reserve the right not to include a message that does not meet these standards.

4. Prices and Payment

4.1 All prices include VAT at the current UK rate. Delivery charges are shown clearly at checkout before you confirm your order.

4.2 We make every effort to ensure prices are accurate. If an error occurs, we will contact you before proceeding. You may choose to pay the correct price or cancel and receive a full refund.

4.3 Accepted payment methods: Credit/Debit Cards (Visa, Mastercard, Maestro), PayPal, Apple Pay, Google Pay. Payment is taken at the time of ordering.

5. Delivery

5.1 We deliver within the United Kingdom only. Delivery times are estimates and not guaranteed unless explicitly agreed.

5.2 Standard delivery: Same day or next day Delivery (Including weekends and public holidays) from dispatch.

5.3 During warm weather (above 22°C), we may delay dispatch to protect product quality. We will notify you of any changes and deliver once conditions are suitable.

5.4 Risk of damage or loss transfers to you once the order is delivered to your specified address. If goods arrive damaged, please notify us within 24 hours of delivery.

5.5 We are not liable for delays caused by circumstances beyond our control, including extreme weather, transport issues, strikes, or postal service disruptions.

6. Right of Cancellation and Returns

For consumers only

6.1 You have the right to cancel your order within 48 Hours from the day you place the order, without giving a reason. Delivered goods are non-refundable

6.3 If you cancel, we will refund all payments, including standard delivery costs, within 48hours after canceling the order. You are responsible for return postage costs unless the goods are faulty or incorrectly supplied.

6.4 Exclusions to cancellation right:

• Personalised or custom‑made items

• Products that expire or deteriorate quickly

• Sealed products where the seal has been opened, for health and hygiene reasons

7. Faulty or Incorrect Goods

7.1 If goods arrive faulty, damaged, or not as described, return the item at delivery time. We will arrange a replacement, exchange, or full refund, including return delivery costs.

7.2 Your statutory consumer rights under UK law are protected and not affected by these terms.

8. Liability

8.1 We are liable only for direct, foreseeable loss caused by our breach of contract or negligence. We do not accept liability for indirect or consequential loss, including loss of profit or business.

8.2 Nothing in these terms limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law.

9. Allergens and Dietary Information

9.1 Our products may contain or come into contact with nuts, milk, soya, wheat, gluten, and other allergens. Full ingredient and allergen information is provided on product pages and packaging.

9.2 If you have allergies or dietary requirements, please check carefully before ordering. We cannot guarantee that our production environment is completely free from traces of all allergens.

10. General Provisions

10.1 These terms are governed by the laws of England and Wales. Any disputes will be resolved exclusively in the courts of England and Wales.

10.2 We may update these terms from time to time. The version published on our website at the time of your order will apply.

10.3 If any part of these terms is found invalid or unenforceable, the remaining provisions remain in full effect.
